This document together with the Terms and Conditions of Use for the Web site available at www.cirque-eloize.com (the “Site”) and any other policies or guidelines displayed on the Site (the “Agreement”), is a contract between you (“you”) and Cirque Éloize (the “COMPANY”, “we”, “us” or “our”) concerning the collection and protection of personal information.

1. Information collected by the Site
The COMPANY collects anonymous information related to the use of its Site to find out which pages of its Site have been consulted by visitors and to compile statistics on their visit, their use of the Site and the frequency of their use of hyperlinks. This information is collected through analytics platforms (Google Analytics), logfiles and cookies. The anonymous information collected is predominantly the following:

- Pages visited and requests;
- Time, day and month visited;
- Duration of visits.

2. How are Anonymous Information and Personal Information collected?
Anonymous Information is collected through the analytics platform Google Analytics, logfiles and cookies.
Google Analytics is a tool that allows the COMPANY to know how the Site is used by users, how they access the Site and which Site pages are most frequently visited.
Logfiles are files that save the trail of requests to the Site server. They give indications of Site traffic and of the type of requests made by Site users.
Personal information is collected through registration forms on the site, surveys, contests and through the recruitment and auditions section of the Site or when you contact the COMPANY by email. You acknowledge that you divulge your personal information to the COMPANY voluntarily.
3.What are the purposes of collecting Anonymous Information and Personal Information?
Anonymous Information allows the COMPANY to know users’ interests, preferences and habits when using the Site. Through the collection of this information, the COMPANY can also improve its Site and offer you the best possible user experience.
Personal information is collected so that the COMPANY can communicate with you, particularly when you sign up for the newsletter, for promotional purposes or contests, following your submission of a job application, or your application to audition, or following any request for services you have made of the COMPANY.

When your Personal Information is transmitted to the COMPANY for personnel recruitment or audition purposes, you accept that this Personal Information is transmitted to third parties who may be interested in your application, and you accept that the COMPANY may contact your references to verify the exactitude of the information supplied, without notifying you in advance. In the event that a position is offered to you, you accept that the COMPANY may request that you supply proof of your right to work in the given territory and that the position is conditional on your having this right.
5.Right to withdrawal
The COMPANY offers you the right to withdraw your Personal Information as you see fit. The right to this withdrawal extends to the rights of internet users to refuse that their personal information be used to certain ends, an option which is mentioned at the information collection stage.
For example, the right to this withdrawal extends to the option offered to users to request that their personal information no longer be part of a general contact list.

The people working for the COMPANY are held to respect the confidentiality of your information. To ensure the security of your personal information, the COMPANY has implemented the following measures:

- Access management – concerned individual;
- Network monitoring software;
- Computer backup system;
The COMPANY commits to maintaining the highest level of confidentiality by integrating innovative technologies in information security in order to guarantee the confidentiality of the Anonymous Information and Personal Information. However, as no mechanism offers maximal security, a small risk is always present while transmitting personal information over the internet.
8.Links provided on the Web site
This Agreement shall be governed by and construed by the laws of the Province of Quebec, Canada and the laws of Canada applicable to contracts between Quebec residents and to be performed in Quebec. Parties hereby irrevocably submit and attorn to the jurisdiction of the Courts of the district of Montreal, Province of Quebec. You agree that any definitive judgment rendered in any action, suit or proceeding is legally binding and may be executed in other jurisdictions by any means stipulated by law.
This Agreement is the entire and exclusive agreement between the COMPANY and you regarding the Site, and this Agreement supersedes and replaces any prior agreements between the COMPANY and you regarding the Site.
You shall not assign or otherwise transfer this Agreement or any of its rights or obligations hereunder to any third party without the prior written consent of the COMPANY which consent is within the COMPANY’s sole discretion. No assignment or delegation by you shall relieve or release you from any of its obligations under this Agreement. Subject to the foregoing, this Agreement shall be binding upon, inure to the benefit of, and be enforceable by each of the Parties and their respective successors and assigns. The COMPANY shall be allowed to assign this Agreement to any third party without requiring your consent.
Nothing in this Agreement shall constitute a partnership or joint venture between you and the COMPANY.
If a particular provision of this Agreement is held to be invalid by a court of competent jurisdiction, the provision shall be deemed severed from this Agreement and shall not affect the validity of this Agreement as a whole.
We do not collect any information indirectly. All the data collected is transmitted voluntarily, whether in the context of the newsletter or a job application.
